Terms of Service (ToS) for EHO Systems
These Terms of Service (Terms) govern your access to and use of all systems provided by EHO360 (EHO), whether you are a customer/client or an employee. Please read these Terms carefully before accessing or using any EHO systems.
1. Acceptance of Terms
By accessing or using any EHO systems, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use any EHO systems.
2. Access to EHO Systems
(a) Authorized Users
Access to EHO systems is limited to authorized users only. Authorized users include customers/clients who have subscribed to our services and employees who have been granted access for work-related purposes.
(b) User Accounts
You may be required to create a user account to access certain EHO systems. You agree to provide accurate and complete information when creating your account and to keep your login credentials secure. You are solely responsible for any activity that occurs under your account.
3. Permitted Use
(a) Use for Intended Purpose
You agree to use EHO systems solely for their intended purpose and in compliance with these Terms, applicable laws, and any additional policies or guidelines provided by EHO.
(b) Prohibited Activities
You must not engage in any of the following activities when accessing EHO systems:
- Violating any laws or regulations.
- Interfering with the operation of EHO systems or the networks connected to them.
- Attempting to gain unauthorized access to any portion of EHO systems or any other systems or networks.
- Transmitting any harmful code, viruses, or malicious software.
- Engaging in any activity that could damage, disable, overburden, or impair EHO systems or interfere with other users' access to them.
4. Intellectual Property
(a) Ownership
All content, materials, and intellectual property rights in EHO systems are owned by EHO or its licensors.
(b) License
The EHO grants you a limited, non-exclusive, non-transferable license to access and use EHO systems for the duration of your relationship with the EHO, subject to these Terms.
5. Privacy
(a) Data Collection
EHO may collect and process personal data in accordance with its Privacy Policy. EHO does not rent, sell or otherwise share user personal information or patient health information with any third party. By using EHO systems, you consent to the collection, processing, and use of your personal data as described in the privacy policy.
(b) Confidentiality
You agree to maintain the confidentiality of any sensitive information or data you may have access to when using EHO systems, and not to disclose such information to unauthorized parties.
6. SMS Terms
Multi-Factor Authentication (MFA)
EHO360 uses Multi-Factor Authentication (MFA) to enhance account security. MFA requires you to provide two or more forms of verification, such as a password and a code sent to your phone, making it more difficult for unauthorized users to access your account.
Opting-In
By agreeing to this Terms of Service, you are opting into Multi-Factor Authentication (MFA). At login, you will be prompted to select your preferred method of receiving security notifications. You can choose to receive SMS messages, email alerts, or both for security verification and account protection. These messages will include authentication codes.
Opting-Out
You may cancel SMS notifications at any time. To opt out of SMS messages, reply "STOP" to any SMS message. Upon sending "STOP," you will receive a confirmation message that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages. If you opt out of SMS, when you next log in to the site, you will be required to select a new Multi-Factor Authentication (MFA) method. At that time, you may choose to receive notifications via either SMS and/or email.

Message Frequency
You will receive one message per login attempt. Carriers are not responsible for delayed or undelivered messages. Message and data rates may apply for any messages sent to or received from us. For questions about your text or data plan, please contact your wireless provider.
Privacy
EHO does not rent, sell, or otherwise share user personal information or patient health information with any third party. For information on how we handle your privacy, please review our Privacy Policy.
7. Termination
EHO reserves the right to suspend or terminate your access to EHO systems at any time and for any reason, without prior notice or liability.
8. Disclaimer of Warranties
EHO systems are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. EHO disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, EHO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of EHO systems, even if EHO has been advised of the possibility of such damages.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Texas.
11. Changes to Terms
The EHO reserves the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on EHO's website or other designated platform. Your continued use of EHO systems after the posting of any revised Terms constitutes your acceptance of such changes.
